When you buy a Legacy High Performance Battery, chances are you won't ever have to worry about the warranty.  If you follow the Legacy Power System recommendations, you can expect a High Performance Battery life of five years -- or longer.

In fact Douglas has one of the lowest warranty return rates in the industry.

5-YEAR WARRANTY

WARRANTY AND ADJUSTMENT AGREEMENT

Legacy Power System High Performance Battery by Douglas Used in Motive Power Applications.

The Legacy Power System High Performance Batteries by Douglas Manufacturing Co., nine (9) through thirty-three (33) plate, are warranted for a period of sixty (60) months against defects in materials and workmanship, subject to the following terms and conditions.  Unless otherwise specified, new battery warranties shall commence upon receipt.

As the sole and exclusive remedy in discharge of this Warranty, the Manufacturer agrees that if the battery fails to deliver 80% of its published rated capacity, or if any cells do not meet Manufacture's specifications, within sixty (60) months from date of receipt, Manufacturer at its option, will either (a) repair cells or battery at its expense, or (b) credit user in an amount equal in dollars to the net purchase price of the original battery against the purchase of another Legacy High Performance Battery by Douglas of equal or greater value in exhange for the unserviceable battery(ies).  Under both options (a) and (b) all transportation costs after the first twelve (12) months from receipt are the responsibility of the user, f.o.b. the Manufacturer's nearest service representative or factory location.  Miscellaneous parts, such as vent caps, cables, and connectors will be warranted for ninety (90) days from date of receipt.  Furthermore, the User must agree to give the Manufacturer prompt notice of such alleged defects and return alleged defective cells, or battery(ies) prepaid to Manufacturer's factory or representative for examination and testing. 

All replaced batteries and cells become the property of Douglas Battery Manufacturing Company.  These warranties are subject to the following terms and limitations: 

1. User and Manufacturer mutually agree each battery is of the proper size, design and capacity for the duty it is to perform and will not be required to perform at any time during the period of the Warranty in excess of this agreed value.
2. Each battery will be matched with a Legacy Power System charger, Douglas charger or Douglas approved charger of proper size and rating and maintained in accordance with Manufacturers printed and supplemental written insutructions.
3. All matched chargers will be equipped with a factory installed UL-listed, Douglas approved automatic control.
4. The lift truck is equipped with a approved lift lockout device.
5. This Warranty is invalid if battery(ies) are subject to misuse, abuse, or physical damage other than ordinary wear and tear.
6. Usef agrees that Manufacturer's Representative may have access to equipment furnished hereunder at least annually for purposes of inspection at reasonable hours and to supply Douglas Battery Manufacturing Company with maintenance/ inspection records. 
7. Battery(ies) are limited to one cycle of charge and discharge of no more than 80% of rated capacity per twenty-four (24) hour day and no more than three hundred (300) cycles per calendar year.
8. Manufacturer undertakes no responsibility for any costs to remove or install battery(ies).
9. Manufacturer undertakes no responsibility for work done or expense incurred in connection with repair or replacement except on specfic authority from our General Sales Office.
10. This Warranty is invalid if average electrolyte temperature of battery is below 45 degrees F or above 100 degrees F.
11. This Warranty and Adjustment Agreement applies only to original purchaser (User) and is non-transferable.
12. This Warranty and Adjustment Agreement applies only to products placed in service in North America.

LIMITATIONS OF LIABILITY:

The above warrantyies are in lieu of all other remedies, including actions for contract or negligence.  All warranties expressed or implied, of merchantability or of fitness for a particular purpose are hereby excluded.  User shall idemnify and save Douglas Battery Manufacturing Company, harmless from any expenses and liabilities arising out of the use, maintenance, possession, transportation, or installation of any battery covered by this agreement, and Douglas Battery Manufacturing Company shall not be liable for indirect, accidental or consequential damages arising out of sale, or relating to the use of the batteries covered hereby.  In no event shall the liability of Douglas Battery Manufacturing Company for any and all claims of breach of warranty or negligence, exceed the purchase price of the battery, or at the election of Douglas Battery Manufacturing Company, the repair or replacement of the defective battery.  Douglas Battery Manufacturing Company makes no warranties which extend beyond the respective time period stated above.  Upon acceptance of Douglas battery(ies), the User acknowledges that these limitaions and disclaimers are conditions of sale and that they constitute the entire agreement between the parties regarding warranty or other liability.  

DOUGLAS BATTERY MANUFACTURING COMPANY

INDUSTRIAL BATTERY CHARGER LIMITED WARRANTY AGREEMENT

Douglas Battery Manufacturing Company (DBMC) warrants that each new Douglas Legacy Gold (DLG) Charger is of good workmanship and free of inherenet mechanical defects for (10) years from date of shipment to the original purchaser subject to the following terms and conditions.

If the charger is found to be defective in materials or workmanship in the ten year period, DMBC will at its option repair or replace the charger or its parts F.O.B. the nearest authorized DBMC service representative.

Douglas Battery Manufacturing Company will cover labor, and travel for the first five (5) years.  Fuses, bulbs, cables, connectors, switches, loose connections and other miscellaneous parts are not warranted. The Legacy Combo Charger is not included in this extended parts warranty.

Replacement parts are covered for thirty (30) days from date of receipt.

DBMC DLG charger warranties are subject to the following terms and conditions.  In order to maintain warranty, the customer must adhere to the following guidelines;

1. Ensure that the charger is the proper size, design and capacity for the duty it is to perform.
2. Provide proper maintenance and repair of charger by qualified personnell authorized by DBMC.
3. Provide proper protection for acid, extreme temperatures, dirt, grime, chemicals, misuse, abuse, or other conditions which effect charger operation.
4. Use proper wiring and fuse protection.
5. Call authorized service personnel when the charger is not working properly.  Authorized representative shall have access to the charger at resonable hours and intervals for purpose of inspection.

Limitaions of Liability:  The above warranties in lieu of all other remedies including actions for contract or negligence.  All other warranties, expressed or implied, of merchantability or of fitness for a particular purpose are hereby excluded.  User shall indemnify and hold DBMC harmless from any expenses and liabilities arising out of use, maintenance, possession, transportation, or installation.  In no event shall the libablity of DBMC for any and all claims of breach of warranty or negligence exceed the purchase price of the charger or, at the election of DBMC, the repair or replacement of the charger.  DBMC makes no warranties, which extend beyond the respective time period stated above.

1. Manufacturer undertakes no cost to remove or install chargers.
2. Manufacturer undertakes no responsibility for work performed or expense incurred in connection with repair except on specific authority from DBMC Quality Assurance.
3. Warranty applies to original purchaser and is not transferable.
4. No lodging or related expenses are covered by this warranty.

1 Year Limited Warranty for Water Supplies & Level Lites

Flow-Rite Controls warrants to the Purchaser that its product, Water Supplies, and Level lites, will be free from all defects in material and workmanship for one (1) year after the date of purchase.  If within one year of the date of purchase, the product, Water Supply, or Level Lite, fails to perform, Flow-Rite will repair or replace the product, Water Supply, or Level Lite, free of charge.  Purchaser should send any product covered under this warranty, along with a copy of the supplier's invoice and description of the problem to Flow-Rite Controls, 960 74th Street SW, Byron Center, MI  49315.  Prior to sending back the product, a Return Goods Authorization numbrr must be obtained by contacting Flow-Rite Controls.

Disclaimer of Warranties:  It is expressly understood and agreed that, the buyer's sole and exclusive remedy shall be repair or replacement of defective parts, and that Flow-Rite Controls shall not be liable for damages or injuries to persons or property.  In no event shall Flow-Rite Controls be liable for more than, and the buyer's exclusive remedy shall be limited to, the price of goods alleged to be defective.  This limited warranty expressly excludes any incidental or consequential damages.

5 YEAR LIMITED WARRANTY FOR MILLENNIUM SPW KITS

Flow-Rite Contols warrants to the Purchaser that its product, Millennium SPW System Kit, will be free of all defects in material and workmanship for five (5) years, after the date of purchase.  If within five years of the date of purchase, the product, Millennium SPW System Kit, fails to perform, Flow-Rite will repair or replace the product, Millennium SPW System Kit, free of charge.  Purchaser should send any product covered under this warranty, along with a copy of the Supplier's invoice and description of the problem to Flow-Rite Controls, 960 74th Street SW, Byron Center, MI  49315.

Disclamier of Warranties:  It is expressly understood and agreed that the buyer's sole and exclusive remedy shall be repair or replacement of defective parts, and that Flow-Rite Controls shall not be liable for damages or injuries to persons or property.  In no event shall Flow-Rite Controls be liable for more than, and the buyer's exclusive remedy shall be limited to, the price of goods alleged to be defective.  This limited warranty expressly excludes any incidental or consequential damagers. 

Note:  Because Flow-Rite's warranty excludes any incidental or consequential damages, Flow-Rite recommends for the first three months checking electrolyte levels once a month.  Thereafter, check electrolyte level once per quarter. 

Freight Terms:   F.O.B. (Freight On Buyer)

Return Policy:  Contact Flow-Rite Controls to obtain a Return Goods Authorization Number.  Returns are subject to a 20% Restocking Fee.

Minimum Order:  $25.00   

Battery Builders 5 Year Warranty Statement

If the Battery Builders battery becomes unserviceable due to defective workmanship or material with 60 months from date of shipment, it will be replaced at Battery Builders option.  There will be no cost for parts or labor, F.O.B. the nearest Battery Builders service location.  Repairs will be made by a Battery Builders servicing agent in the area or a pre-approved battery repair center.  If the battery is to be replaced, it will be replaced with a battery of comparable size and type.

Exceptions;  5, 7, and 9 plate batteries and units with built in chargers will be warranted for a period of 1 Full Year plus an additional 24 months pro-rated or 900 cycles whichever comes first.

CONDITIONS

1.  Each battery must be properly sized in regards to weight and capacity for the duty cycle it is to perform.

2.  The battery must be matched to the proper size charger and proper control to recharge the battery.

3.  The sixty (60) month warranty is based on 1500 cycles and limited to one charge and one discharge within a twenty-four (24) hour period to 80% rated capacity and no more than 300 cycles per calendar year.

4.  Battery Builders warranty will be acted upon if the battery fails to reach 80% of the published rated capacity amp hour at the 6 hour rate to a final voltage of 1.70 volts, when tested under manufacturer's guide lines.

5.  The repair or replacement battery will be warranted only for the remainder of the original period.

6.  This warranty is invalid if the battery is subject to misuse, physical damage, or abuse other than the normal wear and tear.

7.  This warranty applies only to the original purchaser and is nontransferable.

This warranty is void if the battery becomes unserviceable due to fire, wreckage, freezing, neglect, evidence of hif temperatures, any act of God, the use of battery additives or if the battery has been tested, serviced or repaired by someone other than an authorized Battery Builders servicing agent.

Battery Builders shall not be liable for indirect, incidental or consequential damages arising out of the sale or relating to the use of this product.  The purchaser assumes responsibilty for personal injury and property damage resulting from the handling, possession or use of the product.  In no event, shall the liability of Battery Builders Inc. for any and all claims, including claims of breach of warranty or negligence, exceed the purchase price of the product.

This warranty is understood to be the exclusive agreement between the parities relating to the subject matter here for.  No representing agent unless noted so by Battery Builders in writing is authorized to any warranty in addition to those made in this agreement.
